Terms of Service

TalkFast is a game. You hold a key, read the current sentence out loud, and we score how fast and how accurately you said it. Runs are grouped into timed rounds; the highest-scoring qualifying run in a round may set the sentence for the next round. Sponsors can bid to have a word of their choice placed in the sentence.

We may change rules, scoring, round length, thresholds, slot positions, or any feature at any time, and may reset or remove leaderboard entries where we believe scoring was inaccurate or gamed.

You must be at least 13 years old to play and at least 18 (or the age of majority where you live) to place a sponsor bid. If you use TalkFast on behalf of a company, you confirm you can bind that company to these terms.

You may submit a display name, a social handle or website, a sentence for the next round, and — as a sponsor — a word, a brand name, a link and an icon. You keep ownership of what you submit. You grant Burd LLC a worldwide, royalty-free licence to host, display, reproduce and adapt that content on TalkFast and in promotion of TalkFast (for example, screenshots of the leaderboard or sentence) for as long as it appears on the site and for a reasonable time afterwards.

You are responsible for your content. Don't submit anything that is unlawful, hateful, harassing, sexually explicit, defamatory, misleading, that infringes someone else's rights, or that you don't have permission to use (including trademarks and logos). Sentences and words pass an automated profanity filter; we may also remove or edit content at our discretion, with or without notice.

When you play, your microphone audio is recorded for the duration you hold the key. The clip is uploaded to our servers, transcribed by an automated speech-recognition service, timed, and scored. We store clips so that scores can be verified and disputed runs reviewed. Scoring is automated and imperfect; we don't guarantee any particular result and our decision on a run is final.

Don't try to cheat: no synthetic or sped-up audio, no automation, no interfering with the service or other players. We may remove runs and block access if we suspect abuse.

How it works. Each sponsor slot (for example the 2nd, 4th, 8th and 14th word of the sentence) is held by the highest active bid until a higher bid takes it over. Placing a bid authorizes your card for the bid amount through our payment provider, Stripe; it is not charged at that point. Once confirmed, your word, brand name, link and icon appear in the sentence and around the microphone.

Charges and releases. If a higher bid takes your slot within the first 7 days, your authorization is released and you are never charged. If you have held the slot for 7 days, the authorization is captured once — that is the only payment — and the slot is protected from takeovers until that week is complete. After that you keep the slot until outbid, with no refund on being outbid and no voluntary refunds.

Taxes. Bid amounts are in US dollars and exclude any taxes you may owe. You are responsible for any taxes on amounts you pay us, except taxes on our income.

You agree not to: access the service by any means other than the website (including scripted requests to our APIs), probe or overload our infrastructure, circumvent rate limits or bot detection, scrape other users' data, or use TalkFast to spam or advertise except through the sponsor system.

TalkFast is provided as-is and may be unavailable, changed or discontinued at any time. We may suspend or terminate your access for any breach of these terms. Sections 3, 5 (as to money already paid), 8 and 9 survive termination.

TO THE FULLEST EXTENT PERMITTED BY LAW, TALKFAST IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. BURD LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA OR GOODWILL, ARISING FROM YOUR USE OF TALKFAST. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF US$100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, LESS ANY REFUNDS.

Some jurisdictions don't allow certain limitations; in those places our liability is limited to the extent permitted by law.

These terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-laws rules. Any dispute that can't be resolved informally will be brought in the state or federal courts located in Florida, and you consent to their jurisdiction. Before filing a claim, please email us — most issues can be sorted out quickly.

We may update these terms. The date at the top shows the latest version. Material changes to the sponsor terms won't apply retroactively to bids already paid. Continuing to use TalkFast after a change means you accept it.
